Entry Period for Submitting Cause. The Entry Period for the 2018 "State Farm Neighborhood Assist" Program (the "Program") begins at 12:00:01 A.M. ET on June 6, 2018 and ends at 11:59:59 P.M. ET on June 15, 2018 or when 2,000 Entries have been submitted, whichever occurs first.
Eligibility. Entries may be made by legal residents of the 50 United States and the District of Columbia who are 18 years old or older as of June 6, 2018 (each an "Entrant") with internet access and a valid email address at the time of entry. This includes State Farm agents, employees and their immediate families. ENTRIES ARE MADE ON BEHALF OF THE COMMUNITY (City, State) OR 501(C)(3) CHARITY (EACH A "CAUSE") DESIGNATED BY ENTRANT AT THE TIME OF ENTRY AND ENTRANT IS INELIGIBLE TO RECEIVE GRANT MONEY. IF NO 501(c)(3) REGISTERED ORGANIZATION IS SELECTED, ONE WITHIN THE CAUSE'S GEOGRAPHICAL AREA WILL BE ASSIGNED. Void where prohibited. Program is subject to all federal, state and local laws and regulations. The Committee, and those employees involved in the administration and fulfillment of this Program are ineligible to submit a Cause or vote for a Cause.
Nonprofit Administrator Eligibility. Program Sponsor follows the Good Neighbor Citizenship® Company Grants funding guidelines. All 501(c)(3) registered organizations designated as eligible for State Farm funding are eligible to be considered as possible administrators of a Neighborhood Assist grant. How to Submit a Cause. To enter, visit the Neighborhood Assist Website at www.neighborhoodassist.com to (i) log in to the Website, (ii) complete the application ("Application"), (iii) designate a 501(c)(3) organization or a location (city and state) in need, (iv) indicate acceptance of these Official Rules, (v) designate a Category, (vi) upload up to three (3) photos related to your Cause (minimum of one (1) photo), and (vii) designate one (1) photo as the main photo for the entry (collectively the "Entry"). By submitting an Entry, you agree to abide by these Official Rules. Submitter may suggest a nonprofit 501(c)(3) organization to act as administrator of the grant. Your suggested nonprofit organization will not be judged as part of the Entry. All submissions must be in English. ONLY THE DESIGNATED COMMUNITY OR NONPROFIT ORGANIZATION, AND NOT THE ENTRANT, IS ELIGIBLE TO WIN A GRANT IN THE PROGRAM. BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON THE NEIGHBORHOOD ASSIST WEBSITE AT WWW.NEIGHBORHOODASSIST.COM OR ANY OTHER WEBSITE(S) OR PAGE(S) AUTHORIZED BY SPONSOR FOR THE PROGRAM (COLLECTIVELY "THE WEBSITE"), AT SPONSOR'S DISCRETION, AND CAN BE VIEWED BY OTHER WEBSITE USERS. Submission of an Entry grants Sponsor, its subsidiaries, affiliates, advertising and promotions agencies involved in the administration of the Program and their respective agents, and anyone designated by Sponsor, an unlimited, worldwide, perpetual license and right to publish, use, modify, edit, adapt, copy, exploit, and publicly display the Entry in any way, in any and all media, without limitation, and without consideration or acknowledgement to the Submitter. Sponsor reserves the right to modify or edit any Entry, in whole or in part, for content, clarity, or any other reason, and each Submitter waives any and all "moral rights" in and to his or her Entry. Only Entries submitted on the Neighborhood Assist Website will be accepted. No mailed-in, e-mailed, facsimile or other entry methods will be accepted.
Limit of one (1) Submission per person. Entry must designate one (1) of the three Categories - Education, Safety or Community Development. The entry must be in accordance with the terms and conditions stated herein.
Entry Requirements. By submitting an Entry in the Program, you hereby warrant and represent that your Entry conforms to the entry requirements set forth in these Official Rules. Entries must be your original and Entrant's sole creation, and all right, title and interest including but not limited to the copyright and moral rights in any Entry must be owned solely or properly licensed by you. You are responsible for obtaining written permission from any person appearing in any submitted photo to use their likeness in a manner consistent with the rights granted in these Official Rules, and providing such written consent to Sponsor upon request. Entries may not include any: (a) copyrighted works without permission of the copyright owner, (b) false, libelous or defamatory statements about any person or any third party or depict any person, product or entity in a false light; (c) third party trademarks or logos that suggest affiliation with any trademark owner without permission of such owner or that dilute the value of any trademark; (d) profanity, nudity, depictions of violence, threatening language, inappropriate, indecent, harmful, discriminatory, or obscene content as determined by Sponsor and Administrator, in their sole and absolute discretion; (e) communicate messages or images inconsistent with the positive images and/or goodwill with which Sponsor wishes to associate; (f) depiction of an act which is dangerous or suggests any person to undertake a dangerous activity; (g) must not infringe upon any third party's rights, including but not limited to, copyright or rights of privacy or publicity; and (h) cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies. All Entries must be in keeping with Sponsor's image, as determined by Sponsor in its sole and absolute discretion. Sponsor shall have the right, but no obligation, to review the Entries for compliance with these entry requirements. At the Committee's discretion, entries including unsuitable content or that are in, or alleged to be in, violation of third party rights (including, but not limited to, copyrights) may be disqualified, in Sponsor's sole discretion. Sponsor retains sole discretion as to what constitutes unsuitable content and will not be liable in any way for disqualified entries.
Sponsor is not responsible for lost, stolen, illegible, unreadable, misdirected or late Entries. Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. ENTRIES POSTED TO THE WEBSITE ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL SUBMITTER AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. By submitting an Entry, Entrant agrees that his or her disclosure is gratuitous, unsolicited and without restriction, will not place Sponsor under any obligation, that Sponsor and others are free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to Entrant. Entrant acknowledges that, by acceptance of the Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than Entrant. Any waiver of any obligation here under by Sponsor does not constitute a general waiver of any obligation of Entrant. By entering, Entrant acknowledges that Sponsor has no obligation to use or post any Entry.
Identical or similar submissions coming from the same city and state/province will not be disqualified due to duplication. The Committee will retain full decision-making ability on ranking the top causes, so it is possible that nearly identical causes from the same area comprise the top 200 Causes.
Submission Uses and Intellectual Property Rights. By entering, Entrant grants permission for the use of his/her Entry, in whole or in part, and his/her name, and the likeness of any person depicted in the Entry, for use by Sponsor, Administrator and any third party designated by Sponsor in any and all media now known or hereafter devised without territorial or time limitation, including but not limited for posting on the Internet and the Neighborhood Assist Website and/or any website in connection with this Program, in the advertising, promotion, and publicity of the Program, and commercial uses, and otherwise as stated in these Official Rules (as solely determined by Sponsor). Each Entrant warrants and represents that he/she has all right and authority to grant such permission. Notwithstanding anything to the contrary, however, there is no obligation of Sponsor or any other person or entity to post or make any use of any Entry.
Withdrawing Entries. Entrant and/or any 501(c)(3) organization may withdraw their name and submission from consideration at any time by sending an email to neighborhoodassist@statefarm.com, requesting the withdrawal.
Repeat Winners. In the interest of fairness and accessibility and to align with the Program, causes cannot win more than two consecutive years. This would include causes that received two Neighborhood Assist grants consecutively in 2012, 2013, 2014, 2015, 2016 and 2017.
The Committee will use the below rubric for scoring. Each of these questions will be scored with equal weighting on a 10-point scale, to determine a complete perfect score of 30.
State Farm will match any Cause that does not designate a nonprofit organization to an appropriate nonprofit partner in that local area.
Three Committee members will score each of these questions for each cause submission on a point scale of 1-10. They will rank all submissions they receive by average total score from the three readers, and each question will be weighted the same. The Committee will review all submissions based on the three questions asked in the Application. To eliminate ties, each question has been ranked in order of tie-breaking power. In the case of a tie, the Committee will compare scores for questions #1 (if those are exactly the same, then #3 and #2, in that order.)
Out of the top 200 causes, each Category will have at least 15 Causes, determined by the Committee ranked scores. Should the total number of Causes not reach 40, State Farm reserves the right to award less than 40 grants.
Entrants will be notified that they have been selected as a finalist via email to the email address included in the Entry on or about the week of August 6, 2018.
Public Voting. From the period August 15, 2018 at 12:00:01am ET through August 24, 2018 at 11:59:59pm ET, anyone within the 50 United States and District of Columbia who is 18 years of age or older with a valid email address is eligible to vote for a Cause. This includes State Farm agents, employees and their immediate families. Each voter can vote up to ten (10) times per day. These votes can be used all on one Cause, or spread out in any way among multiple Causes in multiple Categories. Votes do not roll over. Users can come back each day to distribute their ten (10) votes. A "day" as defined by these program details is from 12:00:01 am until 11:59:59 pm ET each day. At the end of each day, any remaining unused votes expire.
Sponsor is not responsible for ensuring the accuracy of the voting, and Submitters agree that Sponsor and Administrator are not liable for any malfunctions, inaccuracies, or errors related to the voting or voting process or the results of the consumer voting or voting process.
Finalists. The forty (40) Causes earning the highest number of votes by the end of the voting period will be designated the winners of a "Neighborhood Assist" grant, at $25,000 each, subject to verification that the Cause and voting complied with these Official Rules. There are no limits as to how many Causes will be awarded a grant from each Category. In the event of a tie during the general public voting phase, tiebreaker will be based upon the original score given by the Committee during the Committee review phase.
Affidavit of Eligibility and Liability/Publicity Release. All Entries are subject to confirmation and verification of eligibility by Administrator and Sponsor. The potential grant winners, will be required to provide confirmation (via e-mail) that they would adhere to all grant standards. If the non-profit agency does not sign and return the release within seven (7) calendar days of receipt, or if Sponsor is unable to find a non-profit agency that would administer a grant for the stated Cause, the grant will be forfeited and an alternate Cause may be chosen. By submitting an Entry, each Entrant agrees, and by accepting a grant, each nonprofit organization agrees, to allow and hereby grants to Sponsor, its affiliates and designees the right to use of his/her/its name and Entry (as applicable), in full or in part, in any media, now known or hereafter created, for any and all purposes, without compensation or acknowledgement, including, but not limited to promotional and advertising purposes, except where prohibited.
General Terms and Conditions. All grants are non-transferable and will only be awarded in the name of a verified Cause organization. Submitted suggested organizations are not necessarily the organizations who will administer the grant on behalf of the community. Local branches of the national partner organizations suggested by State Farm on the Neighborhood Assist Website will be given preference for administering the grants. If a particular city does not have a local branch of a national partner organization within a reasonable distance of the cause, then the nonprofit suggested by the Cause submitter will be vetted as a possible recipient of the grant, and Sponsor reserves the right to select administrator recipient of its choosing if no suitable branch can be found from those specific sources, or to disqualify the entry and select an alternate winner. If Sponsor is unable to find organizations to administer eligible grants, or if an insufficient number of eligible entries are received within the entry period, not all grants will be awarded. If any grant notice is returned as undeliverable, or if potential winning Cause organizations' information provided is unintelligible or incorrect, grant will be forfeited, and another Cause selected.
By participating in the Program, Entrant agrees, and by accepting a grant, Cause organization agrees, to release, hold harmless and indemnify Sponsor, Administrator, and each of their respective parent companies, affiliates, subsidiaries, distributors, sales representatives, retailers, advertising, sales promotion and judging agencies and the employees, directors, officers and agents of each ("Sponsor and Administrator") from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorney's fees and court costs) arising directly or indirectly from or in connection with his/her participation in the Program, use of the Entry, acceptance, possession or use/misuse of the grant or participation in any grant-related activity.
Winning Cause organizations are solely responsible for any local, state, provincial or federal taxes on grants (if any). Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of the Program, including without limitation, barring and disqualifying participants who do not comply with these Official Rules. By entering Entrant agrees, and by accepting a grant, winner agrees, that (1) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Program, shall be (i) governed by, and construed in accordance with, the laws of State of Illinois without giving effect to any choice of law or conflict of law rules, (ii) resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Central District of Illinois or the appropriate Illinois state court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs, but in no event including attorneys' fees, disbursements or court costs; and (3) under no circumstances will Entrant or Cause organization be permitted to obtain awards for, and Entrant and Cause organization hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages, other than for actual out-of-pocket costs.
Additional Terms and Disclaimers. Sponsor reserves the right in its sole discretion to disqualify any Entrant it finds to be tampering with the entry process or the operation of the Program or Website or to be acting in violation of the Official Rules. Sponsor reserves the right in its sole discretion to cancel or suspend this Program, in part or in its entirety, if the Program cannot be operated as planned or should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the Program. Sponsor and Administrator are not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Program by any technical or human errors, which may occur in the processing of the entries in the Program. Sponsor and Administrator are not responsible for any typographical or other errors in the offer or administration of the Program, including, but not limited to, errors in the printing or posting of the Program or Official Rules, the selection and announcement of any winner or the distribution of any grant. SPONSOR AND ADMINISTRATOR DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE PROGRAM. SPONSOR AND ADMINISTRATOR ARE NOT LIABLE FOR ANY INJURIES THAT MAY OCCUR FROM THE COMPLETION OF ANY PROJECT ASSOCIATED WITH ANY WINNING CAUSE. EACH ENTRANT AGREES TO EXECUTE ANY DOCUMENT CONTAINING THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES.
Winners List. To view a list of the Program winners, send a self-addressed stamped envelope to "State Farm Neighborhood Assist Winners List Requests," Attn: Human Resources - Philanthropy/D&I Division, One State Farm Plaza, Bloomington, Illinois 61710, or see www.neighborhoodassist.com. The list will be live no earlier than Sept. 25, 2018 and will remain on the Neighborhood Assist Website for at least 30 days.
Privacy Statement. Information collected from each Entrant is subject to Sponsor's Privacy Policy located at http://www.statefarm.com/about/privacy/privacy.asp. Sponsor has engaged a third party company to administer the Program on behalf of Sponsor and personal information provided by Entrant may be collected and used by such third party solely in connection with the administration of the Program and the fulfillment and verification of grant winners' eligibility and award.
E-Mail Communications. By clicking the e-mail communication box within the Neighborhood Assist Website, Entrant consents to receiving future e-mail communications regarding this or any other community-based programs or grant opportunities (in education, safety, or community development) from Sponsor. Entrant will in no way be contacted regarding products or services from any information gathered during this Program.
